Welcome to Humidor AI. By downloading, installing, or using the Humidor AI application (the "App"), you agree to these terms of service ("Terms"). If you do not accept these Terms, do not use the App.

1. Service Description

Humidor AI is a mobile application for cigar enthusiasts that allows you to:

• Identify cigars from photos via artificial intelligence
• Get pairing suggestions with spirits
• Maintain a personal inventory (humidor, bar, tasting journal)
• Back up your data in the cloud

2. Age and Jurisdiction

The App deals with tobacco products and alcoholic beverages. You must be of legal age to consume these products in your jurisdiction (generally 18 in Canada and most European Union countries, 21 in the United States for alcohol, and according to local laws for tobacco).

The App does not sell or deliver any product. It is strictly informational.

3. Account Creation

To use the App, you must create an account. You agree to:

• Provide accurate information
• Keep your email account and any sign-in codes confidential
• Notify us of any unauthorized use of your account
• Be responsible for any activity under your account

4. Pro Subscription

Certain advanced features are available via the Pro subscription:

• Payment is processed by the App Store (iOS) or Google Play (Android); we never receive or store your banking data
• Subscription auto-renews unless cancelled
• A free trial, if offered, automatically converts to a paid auto-renewing subscription at the end of the trial period unless cancelled beforehand
• You may cancel at any time through your App Store or Google Play subscription settings (also accessible via "Manage subscription" in the App)
• No refunds for periods already started, except as required by law

4.1 Right of Withdrawal (European Union consumers)

If you reside in the European Union, you benefit from a 14-day right of withdrawal from the date of subscription, in accordance with Directive 2011/83/EU on consumer rights.

Humidor AI subscriptions being exclusively purchased via Google Play (Android) or Apple App Store (iOS), this right of withdrawal is exercised directly with the distribution platform, whose refund policies incorporate and respect this right:

• Google Play: refund request via play.google.com/store/account/subscriptions
• Apple App Store: refund request via reportaproblem.apple.com

In accordance with applicable EU consumer law, the right of withdrawal may end before the expiration of the 14-day period as soon as the performance of the service (access to Pro features) has begun with your express consent and you have expressly waived your right of withdrawal.

5. Acceptable Use

You agree not to:

• Use the App for illegal purposes
• Share photos that don't belong to you (copyright)
• Submit offensive, defamatory, or inappropriate content
• Attempt to hack, scrape, or extract data through automated means
• Resell or redistribute the service without authorization
• Encourage or promote excessive consumption of alcohol or tobacco

6. Intellectual Property

The App, its code, design, and content belong to Humidor Etc. You may not copy, modify, or redistribute the App without written authorization.

Content you create (notes, tastings, photos) remains your property. By using it in the App, you grant us a limited license to store and process it according to our privacy policy.

7. Statutory Conformity Warranty (European Union consumers)

In accordance with Directive (EU) 2019/770 on the supply of digital content and digital services, consumers residing in the European Union benefit from the statutory conformity warranty. If the App has a conformity defect, you have remedies in accordance with the national transposition laws.

8. Limitation of Liability

The App is provided "as is" without warranty, subject to applicable statutory warranties. To the fullest extent permitted by law:

• We do not guarantee that the App will be available without interruption
• We are not responsible for decisions made based on information provided (purchases, tastings, etc.)
• Our total liability is limited to the amount paid for subscription in the past 12 months
• We are not responsible for indirect damages (loss of profits, loss of data, etc.)

No provision of these Terms shall limit your liability or our obligations to the extent such limitation would be prohibited by applicable law.

9. Health Warning

Consumption of cigars and alcoholic beverages carries health risks. We encourage responsible and moderate consumption. Consult a healthcare professional with questions.

10. Suspension and Termination

We may suspend or terminate your account if you violate these Terms. You may terminate your account at any time via the "Delete my account" option.

11. Changes

We may modify these Terms. The date at the top indicates the last update. Your continued use after modification constitutes acceptance.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of Quebec, Canada. Any dispute will be submitted to the competent courts of the judicial district of Montréal, Quebec.

For consumers residing in the European Union, this clause applies without prejudice to mandatory protections granted by the laws of your country of residence. You retain the right to bring proceedings before the competent courts of your place of residence pursuant to Regulation (EU) 1215/2012 (Brussels I bis).

13. Dispute Resolution and Mediation

Consumers residing in France: in the event of a dispute relating to the performance of these Terms, you have the right to use a consumer mediator free of charge in accordance with Article L612-1 of the French Consumer Code. The mediator competent for Humidor AI will be designated within 30 days following the effective opening of the service to users residing in France. Their contact details will be published in this section as soon as designated.

Consumers residing in the European Union: you may also use the European Commission's Online Dispute Resolution (ODR) platform: ec.europa.eu/consumers/odr.
